By signing, Customer accepts the scope, equipment, materials, and price shown in this estimate and authorizes Paradise Air and Heating LLC, its employees, and authorized subcontractors to perform the listed repair or installation work and obtain applicable permits and inspections.
Scope, Existing Conditions & Limited Responsibility
- This estimate is based on conditions visible and reasonably accessible when inspected. Concealed or pre-existing defects, code deficiencies, hazardous materials, inaccessible utilities, incompatible existing components, structural conditions, duct or electrical defects, drain restrictions, water or mold damage, and work outside the written scope are excluded unless specifically listed.
- If an unforeseen condition or additional work is discovered, Customer will be informed and must approve a written change before the additional chargeable work proceeds, except work reasonably necessary to make the site safe.
- Paradise Air and Heating LLC is not responsible for failure or damage caused by pre-existing conditions, owner-supplied equipment, misuse, lack of maintenance, utility interruption, or systems and property outside the approved scope. To the extent allowed by Florida law, incidental or consequential losses such as loss of use, food, business, or comfort are excluded. Nothing in this agreement waives liability or consumer rights that cannot legally be waived.
- Customer will provide safe access to the work area, secure pets and valuables, and disclose known hazards. Manufacturer warranties and any written workmanship warranty control; no oral warranty or promise of exact energy savings is made.
Payment & Cancellation
A 50% down payment is required before approved work begins. If Customer cancels after parts, equipment, or special-order items have been ordered, a restocking/cancellation fee equal to 25% of the paid down payment may be retained for actual order and restocking costs. Remaining refundable amounts depend on order status and applicable law. Any statutory cancellation right remains unchanged.
According to Florida's Construction Lien Law (Sections 713.001–713.37, Florida Statutes), those who work on your property or provide materials and services and are not paid in full have a right to enforce their claim for payment against your property. This claim is known as a construction lien. If your contractor or a subcontractor fails to pay subcontractors, sub-subcontractors, or material suppliers, those people who are owed money may look to your property for payment, even if you have already paid your contractor in full. If you fail to pay your contractor, your contractor may also have a lien on your property. This means if a lien is filed your property could be sold against your will to pay for labor, materials, or other services that your contractor or a subcontractor may have failed to pay. To protect yourself, you should stipulate in this contract that before any payment is made, your contractor is required to provide you with a written release of lien from any person or company that has provided to you a “Notice to Owner.” Florida's Construction Lien Law is complex, and it is recommended that you consult an attorney.
Florida Homeowners' Construction Recovery Fund. Payment, up to a limited amount, may be available from the Florida Homeowners' Construction Recovery Fund if you lose money on a project performed under contract, where the loss results from specified violations of Florida law by a licensed contractor.
